A construction company carries out major works: new homes and buildings, extensions and renovations that involve the structure, the facade or the layout, with an architect's project and a major works licence. A renovation company usually sticks to minor works: bathrooms, kitchens, floors or painting. If your project changes load-bearing walls, floor slabs or the number of homes, you need a construction company that can carry it out and answer for the structure.
The Building Act (LOE, Law 38/1999) sets three periods from the handover of the works: ten years for damage to the foundations and structure, three for defects affecting habitability and one for finishing defects, for which only the builder is liable. In new residential builds, the developer must also take out ten-year structural insurance covering the structure for those ten years, except for individuals building their own home to live in.
There is no official price per square metre in Mallorca: it depends on the project, the specification and the plot. The average construction cost of new residential builds in Spain was €1,451/m² in the second quarter of 2026 (Grupo ST), and in the Balearic Islands costs are between 30% and 35% higher than in 2019, according to the Builders' Association. On top of the works come 10% VAT and municipal taxes: in Palma, around 5.3% of the budget.
The town council has three months to decide once the file is complete, and for new builds administrative silence means refusal: if it does not answer, there is no licence. On rural land, the Consell de Mallorca report is added, and it has another three months. Since 2024 the licence can also be processed through a collaborating entity (ECU): in Palma, the first licence by this route was granted in February 2026, and the City Council estimates between one and three months.
Site supervision is the job of the architect, as works director, and of the technical architect (aparejador), as construction director; they are the ones who sign the final completion certificate. The construction company builds under their direction, with its own team and site manager, and is responsible for the execution. On completion, the developer receives the Building Logbook, with the project, the handover certificate and the instructions for use and maintenance.
